Terms & Conditions

Everything you need to know before your adventure

1. Definitions & Scope

"Africa Moto Tours" = AMT (as referred to in this document). AMT establishes clear rules of conduct and terms of engagement with its clients to ensure transparency and avoid any misunderstandings. The terms presented on the website, the payment link, the post-registration email, the product pages, and those discussed during the pre-trip video call constitute the binding agreement between AMT and the client.

Important: AMT does not provide flights. Consequently, the company is not responsible for any matter related to air travel, nor for the traveler's arrival at the starting point of the tour in the destination country.

2. Cancellation & Refund Policy — General Terms

Booking a tour with Africa Moto Tours follows a similar overall structure, even though the exact terms differ by destination:

2.1 A deposit is required to reserve your place on a tour. The deposit amount is specified on each tour's page.

2.2 Enrollment for each tour closes a set number of days before departure. This cutoff varies by destination based on local supplier, permit, and logistics requirements.

2.3 Once enrollment closes, full payment of the remaining balance is due.

2.4 Cancelling before a certain point typically allows for a refund of the deposit; cancelling after that point but before final payment is due typically forfeits the deposit; cancelling after final payment is typically non-refundable in cash, since the enrollment cutoff date is always the same date on which funds are transferred to local suppliers (it may sometimes be held as credit toward a future tour, depending on that tour's specific policy).

2.5 There is always a final window close to departure during which no refund or credit is possible, since local suppliers, vehicles, and accommodations are already fully committed on your behalf.

2.6 Because these terms vary significantly from tour to tour — due to the different countries, suppliers, and logistics involved — the specific Cancellation & Refund Policy for your chosen tour, published on that tour's page, is what governs your booking. Please read it carefully before reserving your spot.

3. Emergency Situations & Force Majeure

3.1 Africa Moto Tours reserves the right to cancel a tour, in full or in part, without prior notice, if, at its sole discretion, the safety and well-being of travelers are at risk. Since such a cancellation is initiated by Africa Moto Tours, all payments made will be refunded in full, in accordance with Section 4.

3.2 Force Majeure — Company-Initiated Cancellation: In circumstances beyond Africa Moto Tours' control (including, but not limited to, strikes, government directives, pandemics, natural disasters, or war), Africa Moto Tours shall not be held liable for any direct or indirect damage or inconvenience arising from such circumstances. If Africa Moto Tours cancels the tour in full due to such circumstances, all funds paid (in ILS) will be refunded, minus any non-refundable expenses already incurred by the company on the client's behalf. If the tour is only partially cancelled, refunds will apply only to the portion of ground services that remain unutilized and recoverable.

3.3 Force Majeure — Client Unable to Attend: If a client is unable to attend a tour due to Force Majeure circumstances beyond their control (such as war, government-imposed travel restrictions, flight cancellations, or pandemics), the standard Cancellation & Refund Policy timeframes and terms continue to apply, and no cash refund will be issued outside the standard refund window. As the sole exception to the standard policy, Africa Moto Tours will hold the client's payment as credit toward a future tour date — including in cases falling within the final 14 days before departure, where credit is not normally available — in recognition that the client's inability to attend was outside their control.

4. Company Cancellation & Compensation

4.1 If a tour is cancelled due to an insufficient number of participants, Africa Moto Tours will issue a full refund of all payments made.

4.2 Africa Moto Tours is not responsible for any costs arising from international travel arrangements, including flight delays or flight cancellations, of any kind.

4.3 Africa Moto Tours strongly recommends that all clients obtain travel insurance covering activity cancellations, flight cancellations, and related disruptions.

5. Insurance

5.1 AMT requires all clients to hold valid insurance covering, at minimum:

  • Comprehensive travel insurance
  • Personal accident coverage
  • Extreme sports / adventure sports coverage — explicitly including motorcycle riding and off-road riding by name, as many standard "extreme sports" policies exclude motorcycling unless it is specifically listed.

5.2 Clients may purchase this insurance through any provider of their choice. A copy of the valid policy must be submitted to AMT no later than 14 days before the tour's departure date. AMT reserves the right to refuse a client's participation in the tour if proof of valid, sufficient insurance has not been received by this deadline, with no exception and no refund under those circumstances.

5.3 Given the remote regions covered by many AMT tours, clients are strongly encouraged to confirm their policy also includes:

  • Medical evacuation and repatriation — critical coverage for tours passing through areas without immediate access to advanced medical facilities.
  • Sufficient medical coverage limits — clients should verify their policy's coverage amount is adequate for treatment and evacuation costs in the tour's destination country.

AMT does not sell, broker, or receive commission from any insurance provider, and holds no liability for claims, disputes, or coverage gaps between the client and their chosen insurer.

5.4 Age & Health Requirements: Clients aged 70 or older at the time of the tour's departure are required to submit a medical certificate from a licensed physician, explicitly certifying the client's fitness to participate specifically in this motorcycle touring event — including its physical demands (extended hours of riding, off-road terrain, heat, and altitude, where relevant). A general health certificate that does not explicitly address fitness for this specific tour will not be accepted. The certificate must be issued within 3 months of the tour's departure date and submitted to AMT no later than 14 days before departure, alongside the client's proof of insurance. AMT reserves the right to refuse a client's participation in the tour if this document is not received by the deadline, or if the certificate raises concerns regarding the client's fitness to safely complete the tour, with no exception and no refund under those circumstances.

6. Registration & Pre-Trip Briefing

6.1 Upon registration, clients are presented with, and must accept, these Terms of Use as a condition of participation.

6.2 Clients are responsible for reviewing the tour itinerary provided at booking. Please note: the final itinerary is confirmed approximately one month before departure and remains subject to change due to weather, road conditions, permit availability, or other circumstances beyond AMT's control.

6.3 The Group Meeting: Approximately 10 days before departure, AMT hosts a mandatory group meeting via recorded video call, covering the final itinerary, updates, motorcycle assignments, logistics, and required documentation.

6.4 Attendance Responsibility: Attending the Group Meeting is the client's responsibility. If a client cannot attend, AMT will make reasonable efforts to provide a recording, but the client remains responsible for reviewing it and resolving any outstanding questions independently.

6.5 Health Declaration: A signed Disclosure and Health Declaration form is mandatory for all clients, in addition to any medical certificate required under the Age & Health Requirements section.

6.6 Riding Experience: Clients must have a minimum of one year of riding experience; specific tours additionally require a minimum of one year of ADV riding experience, as indicated on the relevant tour page. During the pre-trip consultation call, clients will be asked to describe their riding experience, and AMT's guide holds sole discretion to determine whether a client is prepared to join the tour. AMT reserves the right to decline participation if this standard is not met (see Section 8).

7. Vehicle Rental Policy

7.1 AMT acts solely as an intermediary between the client and the motorcycle/vehicle rental company. The rental agreement itself is a direct contract between the rental company and the rider; AMT is not a party to it.

7.2 Security Deposit: A valid international credit card, in the renting client's name, is required at the destination to secure a deposit equivalent to the applicable deductible/excess. In some countries, AMT will hold this deposit directly, and it will be returned to the client once the local rental company has inspected the vehicle at the end of the tour. AMT acts solely as an intermediary in this process, receives no commission, and bears no liability for any claims, disputes, or coverage gaps between the client and the rental company.

7.3 Liability: Any claim, cost, or charge relating to damage to, or theft of, the rented vehicle — regardless of fault — is the sole responsibility of the renter. AMT strongly recommends purchasing Deductible/Excess Refund Insurance.

7.4 Inspection: Riders must inspect their assigned vehicle before departure and report any pre-existing damage to AMT staff and the rental company at that time. Damage not reported at this stage may be assumed to have occurred during the rental period.

8. Termination of Participation

AMT reserves the sole right to refuse a client's registration, or to terminate a client's participation in a tour already underway, without refund and without liability to AMT, if:

  • The client poses a safety risk to themselves, other participants, guides, or third parties.
  • The client's conduct disrupts the orderly operation of the tour.
  • The client behaves inappropriately toward guides, fellow participants, or local staff.

A client whose participation is terminated under this section is solely responsible for arranging and funding their own return travel and any related costs.

9. Conduct & Expectations

9.1 Respect: Clients are guests in a country and are expected to observe local customs, laws, and regulations at all times.

9.2 Guide Authority: AMT's guides act as AMT's representatives in the field; their instructions and decisions — including on safety, pace, and itinerary — are final and binding for the duration of the tour.

9.3 Separation from the Group: A client who chooses to deviate from the group's planned itinerary does so entirely at their own risk. AMT cannot provide assistance or supervision during any period a client is separated from the group by choice.

9.4 Zero Tolerance: Any act of physical or verbal violence toward any person will result in immediate expulsion from the tour without refund, and may result in legal action.

10. Accommodations & Dining

10.1 Standards: Service levels vary by country and property. AMT carefully selects its partners and strives for high standards; occasional delays or gaps between expectation and reality may occur and do not constitute a breach of these Terms.

10.2 Guide Privacy: Clients are asked to respect guides' personal time and rest periods outside scheduled tour activities.

10.3 Meals: Included meals are served from a set, limited menu ("Business Menu") at each property. Additional orders and items outside the included menu are at the client's expense. AMT is not liable for illness resulting from food or drink consumed at selected restaurants or lodges.

11. Safety on the Road & in Reserves

11.1 Prohibitions: Smoking inside any vehicle and consuming alcohol during riding hours are strictly prohibited.

11.2 Wildlife: AMT's tours pass through areas inhabited by dangerous wildlife. AMT is not liable for any injury, death, or damage resulting from a wildlife encounter or attack.

11.3 Strict Compliance: Within restricted or protected areas, clients must never exit a vehicle, open a window, or expose themselves outside designated safe zones. Touching, feeding, or interacting with wildlife is strictly forbidden.

12. Shuttles & Local Services

12.1 AMT is not liable for loss of, or damage to, personal belongings during arranged shuttle transfers.

12.2 Communication difficulties may occasionally arise with local drivers due to language differences; AMT will make reasonable efforts to assist but cannot guarantee resolution in every case.

12.3 Tipping: To ensure smooth, consistent service, AMT collects and distributes a collective tip on the group's behalf to local service providers (waiters, drivers, porters, etc.). This does not replace personal tips clients may choose to give at their own discretion.

13. Payment Terms & Currency

All tour prices are quoted in New Israeli Shekels (ILS), based on the prevailing exchange rate at the time of publication. Given currency fluctuations between the deposit date and the final payment date, AMT reserves the right to adjust the final balance due if the relevant exchange rate moves by more than 5% between the date the deposit is paid and the date full payment is due before departure. Any such adjustment will be communicated to the client in writing prior to the final payment request. Once full payment has been received, the price is locked and will not be subject to further adjustment due to currency movement, regardless of exchange rate changes prior to departure.

Accepted payment methods are bank transfer or credit card. Any bank fees, conversion charges, or transfer costs are the responsibility of the client. Clients who choose to pay by credit card will incur an additional surcharge of 2% of the total payment amount, to cover card processing fees. This surcharge does not apply to payments made by bank transfer. The applicable payment method and any associated surcharge will be clearly presented to the client before payment is completed.

14. Visa & Border Responsibility

The client is solely responsible for obtaining all visas, permits, and travel documents required for entry into, transit through, and exit from every country included in the tour itinerary, in accordance with their nationality and passport. AMT can provide general guidance based on common requirements for its client base, but visa and entry requirements are subject to change without notice and can vary by nationality. AMT is not liable for any denial of entry, missed connections, additional costs, or exclusion from the tour resulting from a client's failure to obtain the correct documentation.

15. Vaccination Requirements

Vaccination requirements vary by destination country and may change over time. Some countries included in AMT's tours may require proof of Yellow Fever vaccination or other immunizations for entry or transit. The client is solely responsible for consulting a travel medicine physician or clinic, ideally at least 4–6 weeks before departure, to determine and obtain any vaccinations required or recommended for the specific tour's destination(s). Where known, specific requirements are noted on the relevant tour's page, but this information is for general guidance only and should be confirmed independently with the relevant embassy, consulate, or travel health professional.

16. Booking Transferability

A client who wishes to withdraw from a tour may transfer their booking to a substitute rider at any point up until 14 days before departure, subject to the following conditions:

  • The substitute rider must meet all of AMT's eligibility requirements, including minimum riding experience, age and health requirements, and mandatory insurance.
  • The transfer is subject to AMT's written approval, which will not be unreasonably withheld.
  • Any price difference arising from the transfer (room occupancy, motorcycle selection, package tier) must be settled between the original and substitute client, or directly with AMT, before the transfer is finalized.

Once a transfer is completed, the original client forfeits all rights to any refund, credit, or further claim related to that booking. Transfers are not available within the final 14 days before departure.

17. Assumption of Risk & Release of Liability

AMT organizes and facilitates guided motorcycle touring in remote regions of Africa, including but not limited to off-road terrain, unpaved and undeveloped roads, mountain passes, desert conditions, and areas inhabited by wild and potentially dangerous animals. The client acknowledges and agrees that participation in an AMT tour involves inherent risks, including but not limited to: motorcycle accidents, collisions, falls, and mechanical failure; injury or death resulting from road conditions, weather, wildlife, or third-party actions; exposure to remote areas with limited or delayed access to medical care; and political, security, or civil instability in the tour's destination country or countries.

By registering for an AMT tour, the client voluntarily assumes all such risks, whether known or unknown, and releases AMT, its owners, employees, guides, agents, and affiliated service providers from any and all liability for injury, death, illness, or loss of or damage to property arising from participation in the tour, except to the extent such injury, death, illness, or loss is caused by the gross negligence or willful misconduct of AMT.

This release does not apply to any statutory rights that cannot be waived under applicable law.

18. Limitation of Liability

To the maximum extent permitted by applicable law, AMT's total liability to a client arising from or in connection with a tour, however the claim arises (including negligence), shall not exceed the total amount paid by that client to AMT for the tour in question. AMT shall not be liable, under any circumstances, for indirect, incidental, or consequential damages, including but not limited to lost income, missed flights or connections, or emotional distress, even if AMT has been advised of the possibility of such damages.

19. Indemnification

The client agrees to indemnify and hold harmless AMT, its owners, employees, guides, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) the client's breach of these Terms; (b) the client's negligent act or omission, or willful misconduct; (c) damage caused by the client to a rented vehicle, accommodation, or other third-party property; or (d) the client's violation of any applicable law or regulation in the tour's destination country or countries.

20. Photo, Video & Media Release

During the tour, AMT and its representatives may photograph or film clients as part of AMT's ongoing content creation. By participating in an AMT tour, the client grants AMT a non-exclusive, royalty-free, worldwide, and perpetual right to use such photographs and video footage for marketing, promotional, and archival purposes, including on AMT's website, social media channels, and advertising materials, without additional compensation to the client. A client who does not wish to appear in such materials must notify AMT in writing prior to the tour's departure, and AMT will make reasonable efforts to accommodate such requests, though this cannot always be guaranteed in a group setting.

21. Governing Law & Dispute Resolution

These Terms, and the contractual relationship between the client and AMT, shall be governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms, or to a tour booked with AMT, between the client and AMT, shall be subject to the exclusive jurisdiction of the courts of the State of Israel.

This clause governs the relationship between the client and AMT only. Any matter, dispute, consequence, or legal proceeding arising between a client and a local authority, law enforcement body, government agency, or third party within any country visited during the tour (including, without limitation, customs, immigration, traffic, or criminal matters) is the sole responsibility of the client, and shall be subject to the laws and jurisdiction of that country. AMT is not a party to, and bears no responsibility or liability for, any such matter.

22. General Provisions

22.1 Minors: Any traveler under 18 must be accompanied throughout the tour by a responsible adult who accepts full responsibility for their supervision and safety.

22.2 Agency Relationship: AMT acts as an agent connecting travelers with third-party service providers (rental companies, accommodations, restaurants, etc.). While AMT vets its partners carefully, it is not directly responsible for their independent service delivery, acts, or omissions.

22.3 This document is written in the masculine grammatical form for convenience only; all provisions apply equally to all genders.

23. Amendments to These Terms

AMT may update or amend these Terms from time to time to reflect changes in its operations, policies, or applicable law. The version of these Terms in effect at the time a client completes registration for a tour is the version that governs that specific booking. AMT will publish the current version of these Terms on its website with the applicable effective date.

24. Severability & Entire Agreement

If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect. These Terms, together with the tour itinerary, payment link, post-registration email, and any terms discussed and confirmed during the pre-trip briefing call, constitute the entire agreement between AMT and the client regarding the tour, and supersede any prior oral or written understanding not reflected in these documents.
